IF YOU ARE 18 YEARS OLD OR OLDER:
- Both parties must be present to sign the application.
- Proof of age must be determined by showing acceptable identification such as:
- a valid passport
- a current federal, state, military, or tribal photo identification
- certified birth certificate along with current school or employment photo ID
- certified birth certificate along with a U.S. Department of Treasury Form 4029 that is completed (SDCL 25-1-10.1)
- Your Social Security Number will be required on this form so be sure you know your number.
- The license to marry is valid for 90 days from date of purchase and will become void and of no effect unless the marriage is solemnized within that time frame.
- A license may be purchased in any county in the State and the marriage solemnized in any county in the State. You must keep the license to get married within the State of South Dakota.
- The cost of the license is $40.00.
IF YOU ARE OF THE AGE 16 AND 17:
- You must have a parent or guardian’s written notarized consent. The parent can either come with the bride and the groom upon getting the license or a form is available at this website under Marriage Parental Consent Form. This form would need to be filled out and signed by the parent or guardian of the under-age bride or groom IN FRONT OF A NOTARY PUBLIC. Once it is filled out and signed, please bring it along with you to get your license.
